Welcome to https://balletwithkate.com (the “Website”). This Website and the services offered herein are owned and operated by Kate (hereinafter referred to as “the Instructor”, “we”, “us”, or “our”).

Please read these Terms and Conditions (“Terms”) carefully before using the Website or booking any private ballet instruction services (both online and in‑person). By accessing, browsing, or using this Website, or by booking a class, you (“the Client”, “User”, “you”) agree to be legally bound by these Terms. If you do not agree to these Terms, you must discontinue using the Website and our services immediately.


1. TERMS OF USE & INTELLECTUAL PROPERTY

1.1. Acceptance of Terms & Eligibility

By using this Website, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into a binding agreement.

1.2. Intellectual Property Rights

All content published on this Website—including but not limited to text, graphics, logos, images, video clips, choreography, lesson plans, and digital downloads—is the exclusive intellectual property of Kate and is protected by international copyright laws (including EU regulations and UAE Federal Decree‑Law No. 38 of 2021).

1.3. Prohibition of Recording

To protect the Instructor’s intellectual property and pedagogical methods, the recording of online lessons (via screen recording, camera, or any other electronic device) is strictly prohibited without the prior express written consent of Kate. Any unauthorized recording or distribution of the lessons may result in the immediate termination of services without a refund and may lead to legal action for copyright infringement.

1.4. Privacy and Data Protection (GDPR & UAE Law)

Any personal data collected is processed in strict compliance with the EU General Data Protection Regulation (GDPR) and the UAE Federal Decree‑Law No. 45/2021 on Personal Data Protection.

2. REFUND & CANCELLATION POLICY

2.1. The 24‑Hour Cancellation Rule

  • Timely Cancellation: If you wish to cancel or reschedule a lesson, you must notify the Instructor via email at info@balletwithkate.com at least twenty‑four (24) hours before the scheduled start time.
  • Late Cancellation: Cancellations made less than 24 hours prior to the session are non‑refundable. No make‑up class or credit will be issued.

2.2. Punctuality and Lateness

  • Strict Timing: Lessons start and end at the scheduled times.
  • Client Lateness: If the Client arrives late for a session (online or in‑person), the lesson time will not be extended. The session will conclude at the originally scheduled time, and the Client will be charged the full fee for the session.

2.3. Refund Eligibility

  • Refunds are only issued for cancellations made more than 24 hours in advance.
  • Completed sessions are 100 % non‑refundable.

2.4. Client‑Side Technical Failures (Online Lessons)

Kate shall not be held liable, and no refunds or make‑up classes will be provided, if a session is interrupted or cannot take place due to technical difficulties or internet connectivity issues on the Client’s side.

3. HEALTH & MEDICAL DISCLAIMER

3.1. Medical Clearance & Health Warranty

Physical activities involve inherent risks of injury. By participating, you acknowledge and accept these risks. It is highly recommended that you consult with a physician before commencing any physical exercise program. You agree to notify the Instructor of any physical limitations or medical conditions prior to the session.

3.2. Environmental and Space Safety (Online Lessons)

For online sessions, the Client is solely responsible for ensuring a safe environment. You warrant that:

  • The floor is non‑slip, level, and free of obstructions.
  • There is adequate workspace clearance to move freely.
  • You are using a stable support (e.g., a professional barre or a heavy, non‑slip chair).
  • Appropriate ballet attire and footwear are worn.

3.3. Limitation of Liability

To the fullest extent permitted by applicable law, Kate shall not be held liable for any direct or indirect injuries, muscle strains, or health complications arising out of your participation in the lessons. You hereby release and discharge Kate from any and all claims for personal injury or property damage.

4. GOVERNING LAW & DISPUTE RESOLUTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, breach, or termination thereof, shall be subject to the exclusive jurisdiction of the Dubai Courts.
